Terms of Service

Important: Care Maple is an organisational coordination tool only. It does not provide medical advice, clinical services, or professional caregiving. In any emergency, call 911 immediately.

1. Acceptance of Terms

By creating an account or using Care Maple (“the Service,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

These Terms apply to all users, including circle owners, family members, professional caregivers, and viewers.

2. What Care Maple Is

Care Maple is a family care coordination platform. It helps families and care teams manage tasks, schedule appointments, log care notes, store documents, and generate care records for the purposes of organisation, communication, and accountability.

Care Maple is not:

  • A medical provider, clinic, or health system
  • A licensed home care or professional caregiving agency
  • A substitute for professional medical advice, diagnosis, or treatment
  • A HIPAA Business Associate (see Section 9)

3. Your Account

You must be at least 18 years old to create a Care Maple account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to provide accurate information when signing up and to keep your profile up to date. You may not create an account on behalf of another person without their knowledge.

One person may hold only one account. You may not transfer your account to another person.

4. Care Circles and Invitations

A Care Circle is a private group created around a care recipient. The circle owner controls who is invited and what role they hold. All invitations require explicit acceptance — no one is added to a Care Circle without their consent.

By accepting an invitation to a Care Circle, you acknowledge that your actions within that circle will be logged in a permanent, immutable audit trail. This is a core feature of the platform and cannot be disabled.

5. Acceptable Use

You agree not to use Care Maple to:

  • Post false, misleading, or fraudulent care records
  • Upload content that is illegal, abusive, or violates the rights of others
  • Attempt to gain unauthorised access to another user's circles or data
  • Use the platform to harass, stalk, or harm any individual
  • Reverse-engineer, scrape, or copy any part of the Service
  • Use the platform for commercial purposes outside the scope intended (e.g., reselling access)
  • Circumvent any security or access controls

We reserve the right to suspend or terminate any account that violates these rules.

6. Your Content

You retain ownership of all content you create within Care Maple — tasks, journal entries, documents, and care records are yours. By using the Service, you grant us a limited licence to store and process your content for the sole purpose of providing the Service to you.

You are responsible for the accuracy and legality of the content you submit. Do not upload content you do not have the right to share.

7. Billing and Plans

Care Maple offers a free plan and a paid Pro plan. Paid subscriptions are billed monthly or annually via Stripe. You may cancel your subscription at any time; access continues until the end of the current billing period.

We reserve the right to change plan pricing with at least 30 days' notice to existing subscribers. Free plan features may change at any time.

Refunds are handled on a case-by-case basis. Contact support@caremaple.com within 7 days of a charge if you believe an error was made.

8. Proof of Care Reports

The Proof of Care report generates a timestamped, SHA-256 integrity-hashed record of all care activity within a selected date range. While this report is designed to be legally meaningful and tamper-evident, Care Maple makes no warranty as to its legal admissibility in any specific jurisdiction or proceeding.

The report reflects the data entered by users. We are not responsible for the accuracy of user-entered content.

9. Health Information and HIPAA

Care Maple is designed for family and personal care coordination — not for covered entities or business associates as defined under HIPAA (the U.S. Health Insurance Portability and Accountability Act).

If you are a licensed healthcare provider, health plan, or clearinghouse (a “covered entity”), you must not use Care Maple to store Protected Health Information (PHI) as defined under HIPAA without entering into a separate Business Associate Agreement with us.

For families coordinating personal care for a loved one, HIPAA typically does not apply, and Care Maple is appropriate for this use.

10. Disclaimer of Warranties

Care Maple is provided “as is” and “as available” without warranties of any kind. We do not warrant that the Service will be error-free, uninterrupted, or secure. We do not warrant that the Service is suitable for any particular medical, legal, or professional purpose.

Do not rely on Care Maple as your only record of care. In any emergency, call 911 or your local emergency number immediately.

11. Limitation of Liability

To the fullest extent permitted by law, Care Maple shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to: loss of data, interruption of care, or reliance on care records. Our total liability to you shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

12. Termination

You may delete your account at any time from your Settings page. We may suspend or terminate your account if you violate these Terms, without prior notice for serious violations.

Upon termination, your personal data will be deleted per our Privacy Policy. The audit log entries you created within shared circles will be anonymised (your personal identifier removed) but the care records themselves will remain for other circle members.

13. Changes to Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which Care Maple is registered, without regard to conflict-of-law principles. Any disputes shall be resolved by binding arbitration or in the courts of that jurisdiction.
